1340 encounters in first 10 months of Yogi government : 4 Killings per dayAdvocate Dr. Ajay Pandey 4C Supreme Law InternationalWith the encounter of Assad, the son of mafia Don, Mukhtar Ansari, the issue of police encounter has once again come to fore.Encounter by police refers to a situation where police officers come across a criminal or a group of criminals and engage in a violent confrontation with them, which results in the death of one or more of the criminals. In India, this practice is commonly known as "police encounter" or "encounter killing."The legality of encounters by police in India is a controversial issue. According to the law, police officers are authorized to use force, including deadly force, in self-defense or in defense of others. However, encounters by police have been criticized for being used to bypass the legal system and for violating the rights of suspects. Critics argue that police often stage encounters to avoid having to follow due process and that innocent people are sometimes targeted and killed.In recent years, the Indian government has taken steps to curb the practice of encounter killings. In 2014, the Supreme Court of India issued guidelines on the use of force by police officers, stating that encounters should only be used as a last resort and that a proper investigation should be conducted to determine whether the use of force was justified. Additionally, the National Human Rights Commission has established a task force to investigate encounter killings and to ensure that police officers who engage in extrajudicial killings are held accountable for their actions.Overall, encounters by police in India remain a controversial and sensitive issue, and there is ongoing debate over how to balance the need for law and order with the protection of human rights.In recent times, the number of encounter killings in UP has gone up.However, the prosecution in such killings of police men too has risen, which has stilled fear in the mind of police officials, who are often under pressure to resort to encounter.A police inspector, who was part of such an operation in the past, on the condition of annomity, shared with me that he won't like to be part of such operation as he has paid heavy price in past to come out of the various cases and inquiries, after the encounter.
