Can a builder hide behind development agreement?
This was the question posed at NCLAT in Grand Reality case, in an appeal filled against the decision of insolvency ordered by NCLT.Representing the home buyers we definitely relied upon sale agreement and it's content signed with builder, here in the case Grand Reality.The opposing counsel even submitted to refund the money collected by Grand and also referred to new extesion granted by RERA to the builder.The Hon’ble Court asked to file our reply within two weeks and take up the matter on 11th April, 23.Dr. Ajay Kummar Pandey
